The Portuguese Data Protection Law, “Lei da Proteção de Dados Pessoais” Law no 58/2019, 8th of august, hereinafter, “LPDP”) and the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27th of April 2016, hereinafter “GDPR”) shall ensure the protection of natural persons with regard to the processing of personal data and the free movement of such data. According to the Law, personal data refers to any “information relating to an identified or identifiable natural person, (“the data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, psychological, genetic, mental, economic, cultural or social identity of that natural person” (for example his name associated with his telephone number or e-mail address).

3. PURPOSES OF THE PROCESSING OF PERSONAL DATA

FERCOPOR guarantees the confidentiality of all data provided. Although FERCOPOR collects and processes data in a secure manner and prevents its loss or manipulation using the most appropriate techniques, it should be borne in mind that the collection of data in open networks allows personal data to be circulated without safety conditions, with the risk of being seen and used by unauthorized third parties. Failure to respond to data marked as mandatory, implies the inability to respond to the request of the data subject.

4. LAWFULNESS OF PROCESSING

FERCOPOR processes Users' data:

• when it is necessary for the performance of a contract to which the data user is a party, or for pre-contractual steps at the request of the user;
• when processing is necessary for compliance with a legal obligation to which FERCOPOR is subject;
• when processing is necessary for the purposes of the legitimate interests pursued by FERCOPOR or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child;

In addition to the communications made in compliance with legal obligations, the personal data of the Data Subject may be known, in addition to FERCOPOR, by:

• authorities in general, public administration, public entities and bodies, both national and international;
